Legal and Ethical challenges in Clinical Assisted Reproductive Practices in India

Background

The field of Assisted Reproductive Technology in India faces several ethical and legal challenges. These issues have emerged due to rapid progress in ART practices, societal norms, and lack of robust legal frameworks. An understanding of legal rights, ethical practices and regulatory laws for ART clinics is required to safeguard the interests of various stakeholders. 

Learning Outcome (LO)

  • LO #1: Identify legal challenges regarding ART and surrogacy laws, rights of gamete donors, surrogates, paternity and citizenship issues, laws involving LGBTQ+ parents.  
  • LO #2: Review ethical challenges which need to be addressed, like exploitation of vulnerable group, sex selection, embryo disposal, equitable access to clinical treatment, genome editing, psychological impact on patients, data privacy, use of experimental technologies.   
  • LO #3: Recommend steps to address both legal and ethical issues.
